1. Who is the Controller of your data processing?
The user has contracted the services of Sports Data Innovation S.L., the Spanish company that manages the Argentine company OLIVER S.A.S., with both forming the Oliver Group. The Oliver Group is a provider of software and specialized technical equipment designed to collect data on individuals’ sports activities and relate it to their characteristics and physical condition, with the purpose, among other things, of assessing performance, tracking progress, identifying areas for improvement, or even potential injury risks. This data will be made available to the data controller and to the users of the devices themselves.
2. Area of Application
The information contained in this document applies exclusively to the user data processed by the OLIVER FOR PLAYERS application as detailed herein, and cannot be extended to other websites or data processing activities of the same data controller that are unrelated to the Oliver Group.
It is important to clarify that by accepting these privacy policies, the user agrees that all of their personal data, exclusively those specified at the time of contracting the service, will be fully transferred to Aplazame from the moment the user initiates the contracted deferred payment service offered by the latter at the time of selecting the payment method. This consent also extends to third parties who may need to access the files to ensure proper fulfillment of the contract.
3. When do we collect your personal data?
The personal data regarding the service is collected:
When users register in the application: when you register we request information to identify you, verify your access, and set up your profile as a player.
In your user profile: in your private area, you can add or modify profile data at any time. The available options will vary depending on the type of profile.
When you use the OLI device: once the device is operating, it collects information about the activities of the users who carry it and sends the information to the system so that it is available in the OLIVER FOR PLAYERS application.
Whenever you contact us: the OLIVER FOR PLAYERS application allows users to interact with us, so the purpose of the inquiry and any data resulting from the necessary management to resolve it will be collected.

4. Which personal data do we process?
As regards the data of the users with a Player profile: the information of the users will be filled with the collected information of the OLI device and additional information about the condition of the athlete requested in the OLIVER FOR PLAYERS application. The users’ information of the Player profile shall include physiological, health, geolocation data, lifestyle habits, as well as additional information.
4.1. Payment and Card Information
If you make a purchase from Oliver on our website, you will need to provide your payment information, which includes your name, credit or debit card number, card expiration date, CVV code, and billing address. We do not store this payment information, but we do retain your shipping address in order to fulfill your order. Please note that third-party payment processors may retain this information in accordance with their own terms and privacy policies.
5. Which data do we collect from your device when installing OLIVER FOR PLAYERS?
It is possible that information from the device you use to access the OLIVER FOR PLAYERS application (mobile, computer, tablet, etc.) may be collected. Among the data we may collect are:
Device characteristics: information about the operating system, battery, available storage space, etc.
Device Identifier
Geolocation: this is data we may collect when you enable it.
Device signals: Bluetooth signals and information about beacons, mobile towers, and nearby Wi-Fi access points.

We may use user data to send information related to the application and, if we obtain your consent, we may also send information about other products and services of the Oliver Group. Regarding commercial communications, please note that all messages include an unsubscribe option, so you may exercise your right to object at any time if you change your mind.
We also inform you that we will process your data in an anonymized form for statistical purposes and to improve our tools.
7. How long do we keep your personal data?
We will process your personal data while we keep the relationship with the controller and as long as the user account is activated. The user as well as the controller can cancel the account. Once the account is cancelled, all necessary data will be retained blocked up due to the possibility of legal requirements as long as necessary for the defence of possible claims and to comply with our legal obligations.
The anonymous data shall continue in the Oliver Group system after this period.
8. Underage Data
The only case in which we collect data of minors is the user profile of Player. If users are under 14 years old the controller shall take the necessary measures to verify that the account has the explicit authorization of the parent, tutor, or guardian. The sportsperson user under 14 years old shall be managed by the parent, tutor, or guardian.

9. Processing of special categories of personal data
The collection and processing of any particularly sensitive personal data or personal data included in the special category of personal data of users will only be carried out in cases where we are legally authorized to do so. Special categories of personal data refer to information related to race or ethnic origin, political opinions, religious or philosophical beliefs or other beliefs of a similar nature, trade union membership, genetic data, biometric data for the exclusive purpose of identifying a natural person, health data, sexual life, or sexual orientation.
User information will include physiological and health data, which means that personal data of special categories will be processed.
10. Profiling and automated-decision making
Profiling will use the data provided by the user as well as data collected through the OLIVER FOR PLAYERS application and the OLI device. Data collection will be carried out in an automated manner, and processing will involve human intervention. Sensitive data will be used for profiling, but it will not be cross-referenced or enriched with data from external sources. The consent given does not affect the user’s cookie settings, which will be respected at all times.
The purpose of user profiling is to provide tools to assess performance, track progress, identify areas for improvement, and even detect potential injury risks.
11. What is the legal basis for processing your personal data?
When the user registration is voluntary, it is considered an express statement of consent that legitimizes the processing of your data for the profiling.
In the case of the users with a Player profile, the legal basis of the processing is the consent provided before the controller. In the case of health data processing, the consent shall be explicit.
Sending communications shall be done according to legitimate interest and consent, as required.
It may be possible that legal obligations arise from your activities, so we will process your data according to this legal basis too.

12. What are your rights when you provide us with your personal data?
If we are processing your data, these are the rights you should know:

The personal data that we shall process in the OLIVER FOR PLAYERS application will be the one provided the moment you register and during the relationship and the data collected by the OLI devices.
As your registration depends on the relationship with the controller, the Club, entity or company may provide information for the creation of the user and to confirm if you meet the requirements to formalize the registration. Once registered, the Club, entity, or company responsible may also request your withdrawal from the service. In some cases, the controller may provide personal data that we add to your profile to facilitate the completion of your information.
14. Analytics and Advertising Services Provided by Third Parties
We work with partners who provide us with analytics and advertising services. This includes the necessary assistance to understand how our users interact with the Services, the presentation of online advertisements on our behalf, and measurements of their effectiveness.
