Terms of Sale

These Terms of Sale (“Terms”) apply to all orders you place through the Oliver mobile application or website. By placing an order through these channels, you agree that these Terms are binding. You represent and warrant that you have the legal capacity to accept these Terms. If you are under fourteen years old, or below the minimum age in your jurisdiction, you represent and warrant that you have obtained consent from your parents or legal guardians to accept these Terms. If your order includes Paid Services, our Paid Services Terms are incorporated into these Terms. These Terms reflect a contract between you and Grupo Oliver, and, if applicable, the Oliver-authorized distributor identified in the app, website, or your order confirmation. In these Terms, “Oliver” and “we” refer to Grupo Oliver, its affiliates, and, as applicable, any distributor.

NOT FOR RESALE – SOFTWARE LICENSE

Oliver sells and ships products only to end-user customers, and we reserve the right to reject or cancel your order if we suspect you are purchasing products for resale.

To the extent that the products you order contain Oliver software, consist of such software, or make it available to you in any form, such software is licensed to you and not sold, in accordance with our Terms of Service.

PRICES

Prices are indicated in the currency applicable to the selected location and may not include shipping and handling costs or applicable taxes, which will be communicated to you, if applicable, before you place your order. We reserve the right to change the prices of any product or service on the Oliver app and website at any time and without prior notice.

ORDERS, SHIPPING, AND DELIVERY

We may reject or cancel any order or limit any order quantity at our sole discretion, even after receiving your order. We may also require additional information to meet requirements before accepting or processing your order. While our usual practice is to confirm orders by email, receipt of an email confirmation does not constitute acceptance of your order or our confirmation of an offer to sell a product or service.

If you wish to make a transaction through the app or website, you may be asked to provide certain relevant information, such as your payment and shipping details. YOU REPRESENT AND WARRANT THAT YOU ARE AUTHORIZED TO USE ANY PAYMENT METHOD YOU CHOOSE TO COMPLETE SUCH TRANSACTION. By providing this information, you grant us the right to share it with third parties for the purpose of facilitating the transaction. Verification of information may be required before recognition or completion of any transaction.

The actual delivery of your order may be affected by events beyond our control, and you agree that we are not responsible for delivery delays. Ownership of the products passes to you when the products are delivered to the carrier; however, the risk of loss or damage to the products passes to you upon delivery.

In certain regions, although we operate the Oliver app and website, products and services may be sold through our authorized distributor as a registered distributor, pursuant to contractual arrangements between us and the distributor. As described, this means that a contract is formed between you and the authorized distributor for the supply of those products and services. In such cases, the point of sale or your order confirmation will include the relevant contact information for any matters related to your order. Grupo Oliver and its affiliates are express third-party beneficiaries of these Terms where these Terms apply between you and the authorized distributor.

PRODUCT AND SERVICE AVAILABILITY

We reserve the right to add or remove products and services from the Oliver app and website at any time for any reason. We also reserve the right to modify the quantities available for purchase at any time, including after you have placed your order.

We make no representations regarding the completeness, accuracy, reliability, validity, or timeliness of any product for sale, descriptions, or images (including, but not limited to, attributes and specifications such as weight and size) of any product or service available through the Oliver app or website. Such information and the availability of any product or service (including, but not limited to, the validity of any coupon or discount) are subject to change at any time without notice. We make reasonable efforts to accurately display product attributes, including corresponding colors; however, the actual colors you see depend on your computer system, and we cannot guarantee that your computer will display colors accurately. It is your responsibility to understand and comply with all applicable local, state, federal, and foreign laws (including minimum age requirements) regarding the purchase, possession, and use of any product or service.

COMPATIBILITY

You are responsible for checking the compatibility of products and services with any required equipment (e.g., ensuring you use a compatible mobile device). You agree that lack of compatibility does not constitute a defect giving rise to a claim under our Product Limited Warranty.
